Bill would keep juveniles out of jail in South Dakota

PIERRE, South Dakota - The Legislature was asked Friday to approve a bill that would keep drivers younger than 18 from being locked up more than 48 hours when caught drunk or drugged.

Kevin McLain, director of grants and research in the state Corrections Department, said SB56 would apply to juveniles who are arrested with at least 0.02 percent alcohol in their blood but less than the 0.08 percent legal limit for adult drivers. It also would cover teenage drivers who are smoking marijuana or using other drugs.

Those juveniles currently are handled in adult magistrate courts and may be held for up to seven days, he told the state Senate Judiciary Committee.

South Dakota lawmakers passed legislation last year to ensure that juveniles are not placed in jails for alcohol consumption, and SB56 corrects an oversight by also handling drinking young drivers in juvenile courts, McLain said.

Children caught skipping school, running away or in possession of alcohol cannot be locked up in jails under provisions of the federal Juvenile Justice Delinquency and Prevention Act.

Juveniles who are held for short periods must be separated by sight and sound from adult prisoners.

McLain said those youngsters may be held for 24 hours before initial hearings and then for only 24 more hours until other accommodations are arranged.

At stake if South Dakota doesn't meet provisions of the federal act are healthy grants for state and local efforts to deal with errant juveniles.

South Dakota can expect to get $2 million in grant money in the next couple of months and $850,000 in future years, McLain said. He said 70 percent of the money goes to local governments for juvenile services.

SB56, which will be considered further Wednesday, still would require drinking and drugged young drivers to lose their licenses for six months. However, judges may make exceptions for those who must drive for employment purposes or school.

McLain said 120 South Dakotans younger than 18 were tagged under the 0.02 percent law last year.
